Cheesecake Gets Delisting Notice

Cheesecake Factory Inc. is the latest company to receive notice that it could be delisted from Nasdaq as the company investigates its stock option practices. The delisting notice is standard when a Nasdaq-traded company fails to meet required deadlines for filing quarterly reports. Cheesecake, which launched a voluntary investigation into its stock option accounting practices, has said that it may have to restate some of its previous financial results. The accounting investigation has kept the company from filing its second quarter financial reports on time. Cheesecake, which had previously notified shareholders that it would miss the filing deadline, said it intends to appeal the delisting decision. A recent rash of investigations into stock option practices, some voluntary and some initiated by the Securities and Exchange Commission, has led many companies to miss their filing deadlines and risk delisting.
