AHF to Intervene in Condom Law Litigation

The Valley’s porn industry took another hit this week when a federal judge agreed to give the AIDS Healthcare Foundation standing in a federal lawsuit brought against the law requiring condom use in adult films. AHF sought to intervene in the lawsuit brought by the industry, claiming it had an interest in protecting Measure B, the county ballot initiative approved by voters in November that made condoms mandatory in adult films. AHF collected the signatures that got the measure on the ballot and funded the Campaign Committee Yes on B for its passage. The non-profit asserted that Los Angeles County would not adequately represent the group’s interests. U.S. District Judge Dean D. Pregerson agreed with AHF’s arguments in a ruling released on Tuesday, noting the county stated it was taking a neutral position on the constitutional issues raised against Measure B. “Because defendants (L.A. County) decline to defend the Measure substantively, proposed intervenors (AHF) will offer an element to the proceedings that would otherwise be neglected, namely, a full defense of the constitutionality and validity of the measure,” Pregerson wrote in the 12 page ruling. The lawsuit was filed in January in Los Angeles federal court by Vivid Entertainment LLC, a San Fernando Valley production company, and performers Kayden Kross and Logan Pierce.
