Westfield Topanga Lawsuit Dismissed

A lawsuit seeking to block Westfield Group LLC’s proposed $450 million Village at Topanga project has been dismissed in Los Angeles County Superior Court. The suit, filed by the Woodland Hills Homeowners Organization last year, alleged that Westfield’s addition of a Costco store and gas station violates development guidelines of the Warner Center Specific Plan. Los Angeles Superior Court Judge John A. Torribio dismissed the suit on Tuesday deciding that the 30-acre project did not violate the specific plan, which regulates air quality, aesthetics and other matters. Representatives for the homeowners group said they plan to file an appeal, which could take up to another year. The suit already had been delayed by a year after challenges to several assigned judges. It’s unclear if Westfield will be allowed to begin construction on the sprawling development at Victory and Topanga Canyon boulevards. Westfield’s development came under additional scrutiny last week when the City Council voted to advance a plan that could return up to $59 million to the Australian mall developer over the next 25 years through a tax break.
